I'm unconvinced that this is the case since he has a "Duty to mitigate" clause in the contract he signed. He actually has to make a credible effort to try to find a football related job with some degree of profile attached to it.

Perhaps his incentive would be "I'll settle for $20 million in exchange for you allowing me to retire without having to work in another football related job"?

Did you read all of my post just above? If Kelly could snag a very good booth job, it would be possible for him to make more than 9 mil. a year and for LSU to pay him less than 54 mil. That would be a win win for Kelly and LSU. Kelly would have to negotiate a lump sum payment from LSU at a reduced rate (less than 54 Mil.) and then go seek a booth job that would bring his total comp. to better than 9 mil a year. I don't know what BK's media value is. As I said before, Jordan Rogers makes 2 mil a year at SECN, and Kirk Herbstreit makes 15 mil. a year announcing. Herbstreit has made himself a national brand. I guess BK would be somewhere between those 2.

Or he could take the Ed O route. Do you think Fla, or Auburn, or Penn St or even Arky are interested in BK, after he fowled up the LSU program?

Kelly can't simply sit on his hands, there is a good faith and due diligence requirement in the mitigation clause. See paragraph 3B of Schedule A:


Kelly isn't suing for LSU to pony up all the money up front, per the contract its payable monthly until the outstanding amount is paid in full. What he is suing for is a declaration that LSU did not fire him for cause. If he wins that, LSU would have to begin making monthly payments. However, that would also trigger BK's obligation to use due diligence to find employment. Personally I would have expanded the language and been a bit more specific in the mitigation clause. It's possible LSU tried and the language was negotiated to what it is. I saw a tweet where Brady Quinn was quoted as saying his ND sources tell him BK is done with coaching and that all he wants to do is drink red wine and play golf. Some might say he was already doing that at LSU.

I also think he would probably like to stay connected to the game like Saban has, i.e. some kind of announcing job in college football. LSU didn't go after Ed O, and it does not look like he looked for another job very hard. BK could go on interviews and just not come across very well, and not get selected. It would be hard to prove he did not exercise due diligence in his job search.

He would have to be able to establish proof of his efforts and LSU would have to be able to verify what he was doing. BK couldn't be able to get away with "Hey I tried but nobody would hire me." He would have to give specifics.
 
The report is that it appears LSU wants to fire BK again, for cause this time. If you skip the Kiffin stuff, the BK stuff starts around 21:00. BK's lawyer says they will go after LSU for all that they can (risk). I agree with Mascona.
